General

Quality Electrical Ltd disclaims all warranties, expressed or implied. In no event shall Quality Electrical Ltd be liable for any damages whatsoever, and in particular Quality Electrical Ltd shall not be liable for special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use arising out of use of this website, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise.

Quality Electrical Ltd grants access to the pages contained herein upon condition that the visitor or viewer accepts the jurisdiction of the courts and laws of England to govern matters between us in relation to this web site. This website may include inaccuracies or typing errors. Changes are made from time to time on this website, and to the information contained within it.

Advice received or gleaned from this website should not be relied upon for personal, medical, legal or financial decisions and you should contact an appropriate professional for specific advice tailored to your requirements.

Orders

Orders can be placed by Post, Phone, Fax, and the Internet. When ordering with Quality Electrical Ltd Mail Order, please send a cheque and write on the back of your cheque your guarantee card number and expiry date. Write clearly your Name, Address, Postcode and Telephone Number and the goods that you require in capital letters. Terms are strictly payment with order. All orders will be subject to carriage charges payable in full by the customer.

Prices

We reserve the right to invoice at prices ruling at the time of despatch. Every effort will be made to notify customers of price increase prior to despatch. Goods are offered subject to availability. We do not accept liability for damage or injury caused through misuse of products purchased.

We reserve the right to alter specifications on products without any notice. All retail prices are inclusive of VAT. Postage and Packing also incurs VAT charges. These terms supersede all previous business agreements.

Delivery

Carriage will be charged extra and current carriage charges are available upon request. Times of delivery cannot be guaranteed and Quality Electrical Ltd cannot be held responsible for errors arising outside of its control. Any times quoted for despatch are to be treated as estimates only and in no circumstances will The Company be liable for loss or damage of any kind whatsoever caused directly or indirectly by any delay in the delivery of the Goods.

No claim for damage in transit, shortage of delivery or loss of products will be entertained unless the customer shall have given to Quality Electrical Ltd written notice of such damage, shortage or loss with reasonable particulars thereof, within five working days from the date of delivery. Any claims for damage, shortages or losses shall also be notified by the customer to the carriers in the manner and within the time limit stated in the carrier’s terms and conditions. If the customer fails to give the appropriate notice(s), the customer’s claim will be deemed to have been waived and absolutely barred.

Damage / Loss in Transit

Quality Electrical Ltd will not be held responsible for goods damaged in transit if signed for with no reference to the condition which they were delivered in. Any damages or shortages must be notified on day of receipt of goods. Signed proof from the carrier is required where a complete parcel is damaged or there are shortages of items.

Retention of Title

All goods remain the property of Quality Electrical Ltd until payment in full has been received and cleared.

Payment

Goods will be dispatched only after we receive your cleared funds, unless a credit account has been agreed in advance.

Guarantee & Returns

The customer acknowledges that Quality Electrical Ltd is not the manufacturer of the Goods. Quality Electrical Ltd will endeavour to transfer to the customer the benefit of any warranty or guarantee given by the manufacturer or supplier of the Goods to Quality Electrical Ltd, such guarantee (if applicable) to be limited to free replacement of the Goods subject to compliance with these Conditions of Sale.

In order to enforce the Manufacturer’s guarantee, the Goods must be returned to Quality Electrical Ltd at the customer’s expense adequately packed and accompanied by a returns advice note giving the returns numbers as advised by Quality Electrical Ltd and a copy of the invoice and details of the date when the Goods were supplied, within one month from the date of the invoice.

All goods are sold as non-returnable unless prior arrangement has been agreed by Quality Electrical Ltd.

Goods received by Quality Electrical Ltd without a returns number and a copy of the original invoice will not be accepted. Quality Electrical Ltd may at its discretion charge a minimum re-stocking fee of 50% of the value of the Goods to be returned. The following products will not be accepted for credit repayment: products fitted, used, defaced, or with damaged packaging.

Quality Electrical Ltd will be under no liability under the contract for any personal injury, death, loss or damage of any kind whatsoever (other than death or personal injury resulting from Quality Electrical Ltd’s negligence) whether consequential or otherwise including, but not limited to, loss of profits and The Company hereby excludes all conditions, warranties and stipulations express or implied, statutory, customary or otherwise which but for such exclusion would or might subsist in favour of the customer except that such exclusion will not apply to:-

  • Any implied condition that the seller has or will have the right to sell the goods when the property is to pass
  • When the buyer deals as a consumer as defined in section 12 of the Unfair Contract Act 1977, any implied term relating to the conformity of the goods with their description or sample or as to their quality or fitness for particular purpose

 

In no circumstance will Quality Electrical Ltd or its employees, agents or sub contractors be liable for any loss or damage of any kind whatsoever (other than death or personal injury resulting from Quality Electrical Ltd’s negligence) whether consequential or otherwise caused directly or indirectly by any negligence or other tortuous act or breach of statutory duty on the part of Quality Electrical Ltd or on the part of any of its employees, agents or subcontractors in connection with or arising out of the manufacture or supply of the goods or in connection with any statement given or made (or advice not given or made) by or on behalf of Quality Electrical Ltd.

Any goods returned to Quality Electrical Ltd in accordance with the aforementioned clauses shall belong to Quality Electrical Ltd.

Exchanges

If you need to return all/part of your order for item exchange, please return to Quality Electrical Ltd (address on contact us page of website.) Return Carriage will be charged at £10 per parcel in UK for exchanges. Please ensure that your cheque in payment of these charges is enclosed with your returns and that your cheque guarantee card number is written on the reverse. No return goods will be accepted unless previously agreed by Quality Electrical Ltd.

Refunds

Refunds will ONLY be given for damaged goods where no replacement product can be supplied. Abuse/misuse/incorrect ordering by the customer will NOT be refunded. Goods are not available for inspection or on approval basis. All other refunds will be liable for an administration charge of 10% of the total invoice price.

Disclaimer

We', 'us' or 'our' means Quality Electrical Ltd of Bournemouth, Dorset.

Any disputes not resolved by normal complaints procedure will be resolved exclusively in the courts of England and Wales under English Law.

We will endeavour to take all reasonable care, in so far as it is possible to do so, to keep all details of any orders and payments secure, but, in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering.

Complaints
The contract shall in all respects be constructed and operated as an English contract and in conformity with English law.

We are sorry that you have had to contact us with a complaint. Please be assured that your complaint will be handled in accordance with our internal complaints procedures. We will ensure that:

  • Your complaint is dealt with thoroughly
  • You receive a detailed response to the concerns you have raised
  • Your complaint is dealt with in accordance with the rules set out by Quality Electrical Ltd

Our complaints handling procedure:

  • We may be able to acknowledge and resolve your complaint within 5 working days of its receipt
  • If this is not possible, we will send you a written acknowledgement within 5 days of its receipt, giving you the name of the person handling your complaint and tell you when you can expect to hear from us, this will normally be within 4 weeks of receiving details of your complaint

Who will deal with your complaint:

  • In the first instance, a senior member of staff will deal with your complaint
  • If the first point of contact has been unable to resolve the complaint to your satisfaction, a senior manager will review your complaint and issue a final response
  • If you are unhappy with the final response issued by a senior manager you may be able to refer your complaint to the Director of Quality Electrical Ltd. You will be given those details with a final response letter
